Mecard’s complete overwinning op het Bakugan-octrooi van de Spin Master in China
SEOUL, Zuid-Korea-(BUSINESS WIRE)- Het speelgoedmerk Mecard-dat is ontwikkeld met eigen technologie van het Koreaanse speelgoedbedrijf Choirock Contents Factory Co., Ltd.-won een octrooi-inbreukzaak aanhangig gemaakt door het wereldwijde speelgoedbedrijf Spin Master Ltd. in China.In 2016 diende Spin Master een octrooi-inbreukzaak tegen Mecard in bij het Guangzhou Intellectual Property Court in China, met als argument dat Mecard inbreuk maakte op een octrooi in verband met Spin Master’s Bakugan speelgoed. In het proces oordeelde het Hof dat Mecard speelgoed geen inbreuk maakt op het octrooi van Spin Master’s Bakugan en verwierp het de rechtszaak over de inbreuk op het octrooi van Spin Master. Spin Master ging in beroep, maar het Hof bevestigde de procesbeslissing en maakte de beslissing definitief en niet vatbaar voor beroep. Nu er geen beroep meer mogelijk is, en na bijna drie jaar procederen in China, heeft Mecard eindelijk een volledige overwinning behaald met betrekking tot het octrooi van Spin Master Bakugan. De rechtszaakcampagne van Spin Master tegen Mecard in China is nu ten einde.
Mecard’s Complete Victory over Spin Master’s Bakugan Patent in China
SEOUL, South Korea–(BUSINESS WIRE)– The toy brand Mecard—which is developed with proprietary technology owned by Korean toy company Choirock Contents Factory Co., Ltd.—won a patent infringement lawsuit brought by global toy company Spin Master Ltd. in China.
In 2016, Spin Master filed a patent infringement lawsuit against Mecard in the Guangzhou Intellectual Property Court in China, alleging that Mecard infringed a patent related to Spin Master’s Bakugan toy. In the trial, the Court ruled that Mecard toys do not infringe Spin Master’s Bakugan patent and accordingly dismissed Spin Master’s patent infringement lawsuit. Spin Master appealed, but the Court affirmed the trial decision, making the decision final and not appealable. With no more appeals remaining, and after litigating for nearly three years in China, Mecard has finally won a complete victory with respect to Spin Master’s Bakugan patent. Spin Master’s litigation campaign against Mecard in China has now come to an end.
