Polaris Wireless wint patentzaak tegen TruePosition, Inc.

MOUNTAIN VIEW, Calif. & ZUG, Zwitserland–(BUSINESS WIRE)– Polaris Wireless (Polaris), wereldmarktleider in zeer accurate, op software gebaseerde draadloze lokaliseringssystemen, heeft vandaag bekendgemaakt dat het een geschil over patenten met TruePosition, Inc. (TruePosition) heeft gewonnen. Het Hof van beroep van Washington bekrachtigde het eerdere gelijk dat Polaris haalde bij het Amerikaanse octrooibureau (United States Patent and Trademark Office, USPTO) en de rechtbank. Alle aantijgingen zijn ongeldig verklaard.

Polaris Wireless, Inc. verdedigt zich sinds juni 2012 in een rechtszaak die is aangespannen door TruePosition, dat beweerde dat Polaris’ producten inbreuk maken op zijn patent nr. 7.783.299. Vanaf het begin van het geschil heeft Polaris Wireless gezegd dat zijn Altus-technologie fundamenteel verschilt van de door TruePosition ontwikkelde en gepatenteerde technologie uit het begin van de jaren 2000, die op hardware steunt. Polaris Wireless betoogt ook dat het bewuste patent niet geldig is. Op 26 augustus oordeelde de rechtbank van Delaware dat de beweringen 113 en 114 ongeldig zijn. Op 3 november oordeelde de geschillenraad van de USPTO dat de beweringen 111 tot en met 114 van het TruePosition-patent ongeldig zijn.

 

 

 

Polaris Wireless Wins Patent Dispute Against TruePosition, Inc.

MOUNTAIN VIEW, Calif. & ZUG, Switzerland–(BUSINESS WIRE)– Polaris Wireless (Polaris), the global leader in high-accuracy, software-based wireless location solutions, today announced that it has prevailed in a patent dispute filed by TruePosition, Inc. (TruePosition), a subsidiary of Liberty Broadband Corporation, against Polaris. On December 15, 2015, the United States Court of Appeals for the Federal Circuit in Washington D.C. affirmed Polaris’ wins at the USPTO (United States Patent and Trademark Office) and District Court. All asserted claims were found to be invalid.

Since June 2012, Polaris Wireless, Inc. has been defending a lawsuit brought by TruePosition alleging that Polaris’ products infringe their patent number 7,783,299. From the outset of the litigation, Polaris Wireless has maintained that its Altus technology is fundamentally different from the hardware-based technology developed and patented by TruePosition in the early 2000s. Polaris Wireless has also maintained that the asserted TruePosition patent was not valid. On August 26th, 2014 the Delaware District Court found claims 113 and 114 invalid, and on November 3rd, 2014 the USPTO’s Patent Trial and Appeal Board concluded that Claims 111-114 of the TruePosition patent were invalid. The appellate court affirmed those decisions on December 15, 2015.
