In October 2022, the Düsseldorf Court issued a preliminary injunction for infringement of Seoul’s patent against various LEDs manufactured by Luminus Devices, Inc., and Lite-On Inc., and distributed by Mouser Electronics, Inc.

Lite-On, which manufactured LEDs subject to the injunction, was also sued for patent infringement in U.S. in April 2021 by Sensor Electronic Technology, Inc. (“SETi”), Seoul’s affiliate. Nitride Semiconductors Co., Ltd., and Nitek, Inc., have also filed patent infringement lawsuits against Lite-On in U.S. courts.

Seoul and its affiliates have prioritized patent enforcement against companies that have refused to take responsibility for selling infringing products, including Seoul’s prior litigation against Enplas Corporation and Everlight Electronics Co., Ltd.

In the past four years, Seoul has secured eight injunctions in Europe against the sale of infringing products, including cell phones, electronic home appliances, and general lighting products.

The complaint asserts that Feit lighting products infringe twelve LED patents, and seeks a permanent injunction against the sales of those products.

Seoul Semiconductor (“Seoul”) has already secured permanent injunctions against several retailers selling Feit products in the Eastern District of Texas in 2019 and the Central District of California in 2020.

However, the distribution of suspected infringing products has continued. For that reason, in 2022, Seoul filed a patent infringement lawsuit against Ace Hardware, another distributor of Feit, as well as a patent infringement lawsuit directly against Feit, to cut off the distribution of products believed to be infringing Seoul’s patents.

Seoul has a history of continually pursuing companies that infringe its patents. Everlight Electronics (“Everlight”), a Taiwanese LED package maker, is the world’s eighth biggest LED maker. Based on Seoul’s enforcement, the German District Court of Düsseldorf ordered multiple permanent injunctions and a recall of Everlight’s LED products in 2018-19. In June 2022, Suwon District Court in Korea found Everlight guilty of criminal misappropriation of Seoul’s trade secrets and industry technology, awarding the maximum criminal fines.

Seoul triumphed in six-year litigation against Enplas Corporation, the largest backlight unit (BLU) lens maker, when the U.S. District Court for the Northern District of California ruled that Enplas willfully infringed Seoul’s LED patent, and the U.S. Supreme Court affirmed Seoul’s victory in 2019. Civil damages by Enplas are still pending in another litigation.

Seoul Semiconductor: Everlight Is Criminally Convicted for Misappropriating Seoul Semiconductor’s Trade Secrets and Technology

(KOSDAQ 046890), a leading global innovator of LED products and technology, announced that the Korean Suwon District Court Appellate Division found Everlight Electronics (“Everlight”) guilty of criminal misappropriation of Seoul Semiconductor’s trade secrets and industry technology.

The court awarded criminal fines against Everlight – the maximum fine for a foreign company for the commission of such a crime so far. Three former employees of Seoul Semiconductor (“Seoul”) who left the company and went to work at Everlight were also sentenced to one to two years in prison with two to three years of probation for trade secret and technology misappropriation.

The Korea Prosecutors’ Office criminally indicted Everlight together with Seoul’s former employees for criminal misappropriation of Seoul’s trade secrets and industry technology. The lower court convicted Everlight on a charge of criminal misappropriation of trade secrets, and the appellate court affirmed the lower court’s decision and also upheld a charge of criminal misappropriation of Seoul’s industry technology by Everlight.

In the two cases, which are pending in the U.S. District Court for the Eastern District of Virginia and the German District Court of Düsseldorf, Seoul asserted infringement of its patents by Philips brand TVs, filament LED bulbs, and premium lighting products. Seoul also sought a recall of infringing products as well as the destruction of those products in the German case.

Seoul Viosys Obtains Permanent Injunction Against UV LED Products That Infringe Violeds Patented Technology

ANSAN, South Korea–(BUSINESS WIRE)– Seoul Viosys (“SVC”) (KOSDAQ: 092190), a subsidiary of Seoul Semiconductor Co., Ltd., announced that the United States District Court for the Middle District of Florida issued a permanent injunction against Namsung America, Inc. (“Namsung”). Namsung sold home electronics incorporating UV LEDs manufactured and supplied by SL Vionics Co., Ltd. (previously known as Semicon Light).

Prior to the lawsuit, Namsung ignored repeated notices of patent infringement from SVC. Since 2020, SVC has been requesting that companies stop selling SL Vionics’ LED products. SVC believes that SL Vionics’ LED products infringe SVC’s proprietary Violeds technology, which SVC invented and has been utilizing to produce its UV LED products. When Namsung continued selling products after notice from SVC, SVC filed this lawsuit, which asserted infringement of eleven (11) patents.

The Court’s permanent injunction order applies to any colorable variations of the infringing products, as well as any parties who are in active concert or participation with making or selling such products.

Invesco Developing Markets Fund Welcomes Bombay High Court’s Ruling

Reiterates support for Zee-Sony merger as Currently Proposed; Decides not to pursue the EGM

MUMBAI, India–(BUSINESS WIRE)– Invesco Developing Markets Fund (“Invesco”), Zee Entertainment’s (NSI: ZEEL) (“Zee” or the “Company”) largest shareholder with an ownership interest of nearly 18%, today issued the following statement on the Bombay High Court’s decision recognizing Invesco’s requisition for an extraordinary general meeting (“EGM”) as legally valid and upholding Invesco’s right to requisition an EGM at Zee:

We are pleased with the Bombay High Court’s ruling, which we view as an important reaffirmation of shareholder rights in India and the mechanisms under Indian law to hold Boards accountable to their shareholders. The ruling is a boon for corporate governance in India and a win for shareholder democracy.

Since we announced our intention to requisition an EGM and add six independent directors to Zee’s Board of Directors, Zee has entered into a merger agreement with Sony. We continue to believe this deal in its current form has great potential for Zee shareholders. We also recognize that, following the merger’s consummation, the board of the newly combined company will be substantially reconstituted, which will achieve our objective of strengthening board oversight of the company. Given these developments, and our desire to facilitate the transaction, we have decided not to pursue the EGM as per our requisition dated 11 September 2021.

Invesco will continue to monitor the proposed merger’s progress. If the merger is not completed as currently proposed, Invesco retains the right to requisition a fresh EGM.

The Jiangsu Authority in China recently mediated a lawsuit initiated by The LYCRA Company against four companies found to be infringing on its dual core patents for denim.
