This continues Seoul’s record of successes in patent litigation.

In October 2022, the Düsseldorf Court issued a preliminary injunction for infringement of Seoul’s patent against various LEDs manufactured by Luminus Devices, Inc., and Lite-On Inc., and distributed by Mouser Electronics, Inc.

Seoul has made huge investments in the R&D of optical semiconductors for the past three decades since its establishment. With the establishment of 18,000 intellectual properties, Seoul is leading the second-generation technology in the LED industry. Particularly, WICOP is a revolutionary patented technology essential for manufacturing Mini-LED, Micro-LED, and intelligent front-lighting systems (ADB, Adaptive Driving Beam). This technology realizes the operation of high-power LEDs without wire, package, or optical lenses.

Lite-On, which manufactured LEDs subject to the injunction, was also sued for patent infringement in U.S. in April 2021 by Sensor Electronic Technology, Inc. (“SETi”), Seoul’s affiliate. Nitride Semiconductors Co., Ltd., and Nitek, Inc., have also filed patent infringement lawsuits against Lite-On in U.S. courts.

Seoul and its affiliates have prioritized patent enforcement against companies that have refused to take responsibility for selling infringing products, including Seoul’s prior litigation against Enplas Corporation and Everlight Electronics Co., Ltd.

In the past four years, Seoul has secured eight injunctions in Europe against the sale of infringing products, including cell phones, electronic home appliances, and general lighting products.

“We cannot control the fortune of our birth,” said Chung Hoon Lee, Seoul’s founder, and son of a Korean farmer. “However, we can control treating others fairly during our lifetime. While many global companies emphasize corporate responsibility, such as ESG, they simultaneously disregard others’ hard-earned technology in order to gain short-term profits. This prevents fair competition in our society.”

The complaint asserts that Feit lighting products infringe twelve LED patents, and seeks a permanent injunction against the sales of those products.

Seoul Semiconductor (“Seoul”) has already secured permanent injunctions against several retailers selling Feit products in the Eastern District of Texas in 2019 and the Central District of California in 2020.

However, the distribution of suspected infringing products has continued. For that reason, in 2022, Seoul filed a patent infringement lawsuit against Ace Hardware, another distributor of Feit, as well as a patent infringement lawsuit directly against Feit, to cut off the distribution of products believed to be infringing Seoul’s patents.

Seoul has a history of continually pursuing companies that infringe its patents. Everlight Electronics (“Everlight”), a Taiwanese LED package maker, is the world’s eighth biggest LED maker. Based on Seoul’s enforcement, the German District Court of Düsseldorf ordered multiple permanent injunctions and a recall of Everlight’s LED products in 2018-19. In June 2022, Suwon District Court in Korea found Everlight guilty of criminal misappropriation of Seoul’s trade secrets and industry technology, awarding the maximum criminal fines.

Seoul triumphed in six-year litigation against Enplas Corporation, the largest backlight unit (BLU) lens maker, when the U.S. District Court for the Northern District of California ruled that Enplas willfully infringed Seoul’s LED patent, and the U.S. Supreme Court affirmed Seoul’s victory in 2019. Civil damages by Enplas are still pending in another litigation.

“There are unethical companies that do not respect intellectual properties despite emphasizing corporate responsibility, such as ESG,” said an official at Seoul. “Intellectual property rights are necessary to respect in order to create fair competition in the market.”

About Seoul Semiconductor

SHENZHEN, China–(BUSINESS WIRE)– Hytera Communications (SZSE: 002583), a leading global provider of professional communications technologies and solutions, learned that the US District Court for the Northern District of Illinois has allowed Hytera’s antitrust claims against Motorola Solutions Inc. (“Motorola Solutions”) to move forward. On August 24, 2022, the Court issued a Memorandum Opinion and Order ruling that Hytera alleged sufficient facts in eight of nine counts in its complaint against Motorola Solutions’ anticompetitive conduct in the United States. The Court’s order marks a significant milestone of Hytera’s fight against Motorola Solutions’ anticompetitive scheme that prevents manufacturers of two-way radios from competing on the merits.

Hytera is pleased to see progress in this case and is eager to move forward to prove its allegations through discovery.

In its complaint amended on September 11, 2018, Hytera alleged that Motorola Solutions engaged in anticompetitive conduct violating U.S. federal and state antitrust and unfair competition laws. Hytera asserted that Motorola Solutions has – for decades – engaged in a scheme to monopolize the market for Land Mobile Radios (“LMRs”) in the United States. The Complaint further alleges that in recent years, Motorola Solutions has targeted Hytera in its anticompetitive conduct, and that it has succeeded in foreclosing Hytera and other competitors from the market. Specifically, Hytera alleged that Motorola has engaged in a scheme to promote a system of exclusive dealing combined with tying and leveraging, serial sham petitioning, and a coordinated campaign of misinformation about Hytera’s products.

Hytera filed its original complaint in December 2017 in the United States District Court for the District of New Jersey. The case was later transferred to the U.S. District Court for the Northern District of Illinois. The motion decided by the Illinois Court had been pending since April 2019.

Hytera looks forward to proving in Court how Motorola Solutions’ anticompetitive conduct has harmed competition and consumers.

Seoul Semiconductor: Everlight Is Criminally Convicted for Misappropriating Seoul Semiconductor’s Trade Secrets and Technology

The court awarded criminal fines against Everlight – the maximum fine for a foreign company for the commission of such a crime so far. Three former employees of Seoul Semiconductor (“Seoul”) who left the company and went to work at Everlight were also sentenced to one to two years in prison with two to three years of probation for trade secret and technology misappropriation.

The Korea Prosecutors’ Office criminally indicted Everlight together with Seoul’s former employees for criminal misappropriation of Seoul’s trade secrets and industry technology. The lower court convicted Everlight on a charge of criminal misappropriation of trade secrets, and the appellate court affirmed the lower court’s decision and also upheld a charge of criminal misappropriation of Seoul’s industry technology by Everlight.

Seoul is the top LED company in Korea and No. 3 in the world. Over the past 30 years, Seoul has devoted itself to R&D with a vast patent portfolio and is leading second generation LED technology. However, some global companies still purchase cheaper copycat products that infringe Seoul’s technology and sell those products under their branding, despite alleging their compliance with ESG.

Seoul Semiconductor Files Patent Infringement Lawsuits Against Philips TV and Filament LED Bulbs in Europe and U.S.

ANSAN, South Korea–(BUSINESS WIRE)– Seoul Semiconductor Co., Ltd. (“Seoul”), a leading global innovator of LED products and technology, announced that, in April 2022, it has launched patent infringement lawsuits against Ace Hardware, a global retail company, in the U.S., and, in Europe, against a distributor of Conrad Electronic’s sales platform.

Premium light bulbs and TV products with phosphor technology for high-quality color gamut and WICOP technology (Graphic: Business Wire)

In the two cases, which are pending in the U.S. District Court for the Eastern District of Virginia and the German District Court of Düsseldorf, Seoul asserted infringement of its patents by Philips brand TVs, filament LED bulbs, and premium lighting products. Seoul also sought a recall of infringing products as well as the destruction of those products in the German case.

In these lawsuits, Seoul’s patents cover phosphor technology for high-quality color gamut and WICOP technology.

Seoul has developed its phosphor technology together with a Japanese company (“M”) over 15 years and has succeeded in producing LED lights that are the closest spectrum to natural light. Based on the quality of these lights, which is recognized in the industry, Seoul’s phosphor technology can be found in premium lighting products requiring more than CRI (color rendering index) 90, as well as display products.

WICOP is a revolutionary patented technology that is compactly designed without wire bonding or packaging, thus enabling LEDs to be mounted directly in a PCB assembly. WICOP technology has been adopted in over 100 car models, which is approximately 10% of the global automobile market. It is also widely used in about 20% of the global TV market as of 2020.

Seoul has already successfully obtained permanent injunctions against various infringing products several times in Europe and the U.S. In September 2020, the German District Court of Düsseldorf issued permanent injunctions, an order of recall and destruction against filament LED bulbs manufactured by a Phillips brand affiliate. In 2019 and 2021, the U.S. District Court for the Central District of California and the New Jersey District Court issued permanent injunctions against the sales of a Philips TV product and 13 automotive lighting brand LED products respectively.

“While global companies emphasize corporate responsibility, such as ESG, many companies still use copycat products that stole others’ hard-earned technology in order to gain short-term profits,” said Myeong-Ki Hong, CEO of Seoul. “It is a pity that there are unethical companies that seek profits at the expense of others’ sweat and tears,” he added.

About Seoul Semiconductor

Seoul Semiconductor is the world’s second-largest global LED manufacturer, a ranking excluding the captive market, and has more than 10,000 patents. Based on a differentiated product portfolio, Seoul offers a wide range of technologies, and mass produces innovative LED products for indoor and outdoor lighting, automotive, IT products, such as mobile phones, computer displays, and other applications, as well as the UV area. The company’s world’s first development and mass production products are becoming the LED industry standard and leading the global market with a package-free LED, WICOP; a high-voltage AC-driven LED, Acrich; an LED with 10X the output of a conventional LED, nPola; a cutting edge ultraviolet clean technology LED, Violeds; an all direction light emitting technology, filament LED; a natural sun spectrum LED, SunLike; and more.

Seoul Viosys Obtains Permanent Injunction Against UV LED Products That Infringe Violeds Patented Technology

ANSAN, South Korea–(BUSINESS WIRE)– Seoul Viosys (“SVC”) (KOSDAQ: 092190), a subsidiary of Seoul Semiconductor Co., Ltd., announced that the United States District Court for the Middle District of Florida issued a permanent injunction against Namsung America, Inc. (“Namsung”). Namsung sold home electronics incorporating UV LEDs manufactured and supplied by SL Vionics Co., Ltd. (previously known as Semicon Light).

Prior to the lawsuit, Namsung ignored repeated notices of patent infringement from SVC. Since 2020, SVC has been requesting that companies stop selling SL Vionics’ LED products. SVC believes that SL Vionics’ LED products infringe SVC’s proprietary Violeds technology, which SVC invented and has been utilizing to produce its UV LED products. When Namsung continued selling products after notice from SVC, SVC filed this lawsuit, which asserted infringement of eleven (11) patents.

The Court’s permanent injunction order applies to any colorable variations of the infringing products, as well as any parties who are in active concert or participation with making or selling such products.

SVC’s CEO, Young-joo Lee, said, “There are companies that seek to increase their profits by using other companies’ patented technology. This is not only immoral, but it seeks to cheat inventors everywhere who have invested and believed in their ideas.”

In order to protect its hard-earned technology and promote a fair marketplace, SVC actively pursues enforcement against suspected infringing UV LED products all over the world. As an example, SVC recently brought a search and seizure of suspected infringing products against FNAC Darty Group, a large European retailer, and subsequently filed a patent infringement lawsuit in France. SVC also filed a patent infringement lawsuit against a European distribution company in the Netherlands, seeking a preliminary injunction against its UV LED products.

Invesco Developing Markets Fund Welcomes Bombay High Court’s Ruling

Reiterates support for Zee-Sony merger as Currently Proposed; Decides not to pursue the EGM

MUMBAI, India–(BUSINESS WIRE)– Invesco Developing Markets Fund (“Invesco”), Zee Entertainment’s (NSI: ZEEL) (“Zee” or the “Company”) largest shareholder with an ownership interest of nearly 18%, today issued the following statement on the Bombay High Court’s decision recognizing Invesco’s requisition for an extraordinary general meeting (“EGM”) as legally valid and upholding Invesco’s right to requisition an EGM at Zee:

We are pleased with the Bombay High Court’s ruling, which we view as an important reaffirmation of shareholder rights in India and the mechanisms under Indian law to hold Boards accountable to their shareholders. The ruling is a boon for corporate governance in India and a win for shareholder democracy.

Since we announced our intention to requisition an EGM and add six independent directors to Zee’s Board of Directors, Zee has entered into a merger agreement with Sony. We continue to believe this deal in its current form has great potential for Zee shareholders. We also recognize that, following the merger’s consummation, the board of the newly combined company will be substantially reconstituted, which will achieve our objective of strengthening board oversight of the company. Given these developments, and our desire to facilitate the transaction, we have decided not to pursue the EGM as per our requisition dated 11 September 2021.

Invesco will continue to monitor the proposed merger’s progress. If the merger is not completed as currently proposed, Invesco retains the right to requisition a fresh EGM.
