GENEVA–(BUSINESS WIRE)–The new Code of Practice of the International Federation of Pharmaceutical Manufacturers and Associations (IFPMA) came into effect on 1 January 2019. The 2019 Code is marked by two important changes. First, it bans gifts and promotional aids (so-called “goodies”) for prescription medicines, wherever IFPMA member companies operate. Second, it introduces a shift from a rules-based approach to a values-based Code, which seeks to help better guide business behaviors and interactions between IFPMA members and the healthcare community.

Part of the ban on gifts are any exceptions based on the custom of gifts to mark significant national, cultural or religious events (for example, mooncakes or condolence payments). This brings the rest of the world in line with current European and US guidelines. The ban reflects pharma industry’s commitment towards the general concern that the promotional items trivialize the important, professional relationship that must exist between medical representatives and healthcare professionals, and that has the patient’s interests at its core. This relationship is based on the concept that mutual exchange ensures that the patient benefits from all sides sharing expertise and scientific knowledge, enabling the development and effective use of new medicinal products and vaccines.

Verdicts Against Huawei and ZTE Enforced in Germany

DENVER–(BUSINESS WIRE)– MPEG LA announced today that patent holders in MPEG LA’s AVC/H.264 Patent Portfolio License have enforced verdicts of injunction in German District court (“Landgericht Dusseldorf”) cases finding that Huawei Deutschland GmbH (“Huawei”) and ZTE Deutschland GmbH (“ZTE”) infringed patents by their use in mobile phones that implement the AVC/H.264 (MPEG-4 Part 10) Standard. Against Huawei the case 4a O 17/17 (EP 1 773 067/Appeal case no. I-15 U 73/18) has been enforced.

Against ZTE the case 4b O 5/17 (EP 1 750 451/Appeal case no. I-2 U 76/18) has been enforced.

In both cases the Court of Appeals (“Oberlandesgericht Dusseldorf”) has dismissed Huawei’s and ZTE’s requests for an immediate stay of the enforcement while the cases are under appeal.

As a result, Huawei and ZTE must cease and desist from offering in Germany AVC/H.264 compliant devices such as smartphones and tablets that use the enforced patents. In addition, all such products in their possession or the possession of third parties must be recalled and destroyed.

VLN^TM-sigaretten bevatten minstens 95% minder nicotine dan elk van de 100 leidende sigarettenmerken in de Verenigde Staten.

22nd Century Group, Inc. (NYSE American: XXII), een bedrijf in plantenbiotechnologie dat gericht is op tabaksschadebeperking en VLN-tabak (Very Low Nicotine tobacco, tabak met zeer laag nicotinegehalte), heeft vandaag een MRTP-aanvraag ingediend voor een gewijzigd risico tabaksproduct bij de Amerikaanse Food and Drug Administration (FDA) voor de sigaretten met een zeer laag nicotinegehalte (VLNC) van het bedrijf. De door de 22nd Century voorgestelde VLN^TM-sigaretten, het onderwerp van de MRTP-aanvraag, zijn gemaakt met de eigen VLN^TM-tabak van het bedrijf en bevatten daardoor zeer lage nicotinegehalten.

Er zijn bijna 38 miljoen rokers in de Verenigde Staten. In een speciaal rapport, gepubliceerd in het nummer van het New England Journal of Medicine van mei 2018, voorspelde een door de FDA gefinancierd statistisch model dat, als alle sigaretten in de Verenigde Staten een zeer laag nicotinegehalte zouden moeten hebben, ongeveer 5 miljoen rokers binnen een jaar zouden stoppen met roken en dat dat aantal binnen 5 jaar zou toenemen tot een totaal van 13,0 miljoen. Tot het jaar 2100 schat het model dat ongeveer 33 miljoen mensen zouden stoppen met roken of er niet mee zouden beginnen. Het model voorspelt verder dat 8,5 miljoen sterfgevallen zullen worden voorkomen en dat er tot het jaar 2100 sprake zal zijn van een winst van 134,4 miljoen aan levensjaren.

De MRTP-aanvraag van 22nd Century voegt zich bij de eerder ingediende Premarket Tobacco Application (PMTA) van het bedrijf. Samen streven deze belangrijke aanvragen naar de toestemming van de FDA om de VLN^TM-sigaretten van het bedrijf te commercialiseren en om te adverteren dat de VLN^TM-sigaretten 95% minder nicotine bevatten in vergelijking met de 100 leidende sigarettenmerken in de Verenigde Staten.

De door 22nd Century voorgestelde VLN^TM-sigaretten zijn dezelfde als de stijl met het laagste nicotinegehalte van de SPECTRUM®-onderzoekssigaretten van het bedrijf. De SPECTRUM®-onderzoekssigaretten van 22nd Century werden ontwikkeld in samenwerking met de FDA en andere Amerikaanse federale overheidsinstanties om onafhankelijke wetenschappers te voorzien van de producten die nodig zijn om onderzoek te doen naar de voordelen voor de volksgezondheid van sigaretten met een verlaagd nicotinegehalte. De MRTP-aanvraag van 22nd Century verwijst naar meer dan 50 onafhankelijke onderzoeken die gebruik hebben gemaakt van SPECTRUM®-onderzoekssigaretten. Van bijzonder belang was het zes weken durende onderzoek met 840 deelnemers van Donny, et al., gepubliceerd in het New England Journal of Medicine in oktober 2015, waaruit bleek dat VLNC-sigaretten: ‘geassocieerd [werden] met vermindering van roken, minder blootstelling aan nicotine en minder nicotineafhankelijkheid, met minimaal bewijs van nicotineontwenning, compensatoir roken of ernstige bijwerkingen.’ Een twintig weken durend onderzoek met 1.250 deelnemers van Hatsukami, et al., gepubliceerd in het Journal of the American Medical Association (JAMA) in september 2018, concludeerde dat een onmiddellijke vermindering van nicotine tot zeer lage gehaltes geassocieerd werd met:

• Lagere toxische blootstelling in de loop van de tijd;
• Minder gerookte sigaretten per dag;
• Grotere vermindering van nicotineafhankelijkheid; en
• Meer dagen waarop deelnemers geen sigaretten rookten (dagen zonder sigaretten).

Het roken van sigaretten is de belangrijkste oorzaak van vermijdbare ziekten en sterfgevallen in de Verenigde Staten, goed voor meer dan 480.000 sterfgevallen per jaar, of ongeveer 1 op de 5 sterfgevallen, en meer dan 300 miljard dollar aan kosten voor de gezondheidszorg. Op basis van het actuariële model dat wordt gefinancierd door de FDA, hebben VLNC-sigaretten het potentieel om de loop van de geschiedenis van de volksgezondheid te veranderen door bij te dragen aan het einde van de wereldwijde tabaksepidemie.

Het verminderen van het nicotinegehalte van sigaretten tot niet-verslavende niveaus maakt al lang deel uit van de visie van de FDA om de schade die veroorzaakt wordt door roken te verminderen. In een persbericht van 16 juni 2010 raadde Dr. David Kessler, de voormalige FDA-commissaris, aan: “De FDA moet snel besluiten tot het verlagen van het nicotinegehalte in sigaretten tot niet-verslavende niveaus. Als we het niveau van de stimulans verlagen, verminderen we de hunkering. Het is de ultieme schadebeperkingsstrategie.” (cursivering toegevoegd)

Op 28 juli 2017 verklaarde Dr. Scott Gottlieb, de huidige FDA-commissaris, bij de introductie van het uitgebreide plan van de FDA voor de regulering van tabak en nicotine in een openbare aankondiging: “Zoeken naar manieren om het nicotinegehalte in sigaretten te verminderen, zodat ze minimaal of niet verslavend zijn …. is een hoeksteen van onze nieuwe en meer alomvattende aanpak ten aanzien van effectieve tabaksregulering.”

En dit najaar besprak Lynn Hull, hoofdfarmacoloog bij de afdeling Individual Health Science binnen het Center for Tobacco Products van de FDA, tijdens een FDA-webcast de wetenschap achter het voornemen van de FDA om een voorgestelde regel uit te geven die, indien gefinaliseerd en van kracht, de hoeveelheid nicotine zou beperken in alle in de Verenigde Staten verkochte sigaretten (en misschien ook in alle andere verbrande tabaksproducten) tot minimaal verslavende of niet-verslavende niveaus. In de webcast gaf Dr. Hull aan dat een minimaal verslavend of niet-verslavend nicotinegehalte in sigaretten tussen ongeveer 0,2 tot 0,7 mg nicotine per gram tabak zou kunnen liggen.

In tegenstelling tot de zeer verslavende tabakssigaretten die op de markt gebracht worden door Big Tobacco-bedrijven, Altria Group, Inc. (MO) en Reynolds American Inc., een dochteronderneming van British American Tobacco (BTI), maken de eigen VLNC-tabak en -technologie van 22nd Century tabakssigaretten mogelijk met een nicotinegehalte dat meer dan 95% minder is dan in conventionele sigaretten.

In tegenstelling tot andere sigaretten op de Amerikaanse markt vandaag de dag, vallen de voorgestelde VLN^TM-sigaretten van 22nd Century – met slechts 0,5 mg nicotine per gram tabak (~0,3 mg per sigaret) – helemaal binnen het nicotinebereik zoals voorzien door Dr. Hull van de FDA.
